**Essential India Tax Guide: Bitcoin, NFTs, Airdrops, Gifts & Overseas Crypto Wallets**

*India’s virtual digital asset taxation remains among the world’s toughest. Investors face a flat thirty percent tax on gains and a one percent TDS on every transaction. Specific provisions now govern the taxation of cryptocurrencies, non‑fungible tokens, airdrops, staking rewards, gifts and even holdings in overseas crypto wallets.*

### Introduction
Since the Finance Act 2022 introduced a dedicated regime for virtual digital assets (VDAs), Indian crypto participants have navigated a labyrinth of reporting requirements. The government’s stance—taxing gains at 30 % irrespective of holding period and levying a 1 % tax deducted at source (TDS) on each transfer—has sparked debate among traders, developers and institutional players. Understanding how these rules apply to different asset classes and cross‑border activities is now essential for compliance and strategic planning.

### Key Developments
1. **Flat 30 % Capital Gains Tax** – Profits from the sale, swap or conversion of Bitcoin, Ethereum, NFTs or any other VDA are taxed at the highest slab, with no indexation benefit. Losses cannot be set off against other income, though they may be carried forward for up to eight years to offset future VDA gains.
2. **One‑Percent TDS** – Effective July 2022, every crypto transaction exceeding ₹10,000 (or ₹50,000 for specified persons) attracts a 1 % TDS, deducted by the exchange or peer‑to‑peer platform. The deducted amount can be claimed as a refund while filing returns, provided the taxpayer furnishes Form 26AS.
